美參院提案封殺體育與賭場型預測合約，州聯邦監管權拉鋸升溫，Kalshi、Polymarket 面臨多州訴訟壓力。
根據《華爾街日報》報導，美國兩黨參議員將在周一提出新法案，擬禁止受聯邦監管的預測市場平台提供涉及「體育賽事」與「賭場型遊戲」的合約，標誌著美國參議院首度嘗試限制高速擴張的預測市場。
這項法案由民主黨籍參議員 Adam Schiff 與共和黨籍參議員 John Curtis 共同發起，主張全面禁止受美國商品期貨交易委員會（CFTC）監管的預測市場—— 包括 Kalshi 、 Polymarket 美國平台 —— 上架任何與體育賽事相關的事件合約。
不僅如此，禁令範圍更將延伸至所謂的「賭場式產品」，舉凡拉霸機（老虎機）、二十一點、撲克牌以及賓果遊戲等相關預測市場，皆在封殺之列。
Adam Schiff 指出：「美國 CFTC 不僅為這些市場大開綠燈，甚至還促進它們的發展。」
他認為，美國國會應該消除這個「違反各州消費者保護法、侵犯部落主權且對政府財政收入毫無貢獻」的監管漏洞。
John Curtis 則表示：「猶他州有太多年輕人接觸到令人上癮的體育博弈和賭場式遊戲合約，這些應該由州政府監管，而不是交給聯邦監管機構。」
這項立法提案的出現，正值美國監管機構、各州政府與業界之間對「預測市場」監管權限的爭議持續升高之際。
儘管 Kalshi 與 Polymarket 等平台提供了橫跨加密貨幣、政治選舉、氣候變遷乃至流行文化等多重領域的「二元合約（Binary Contracts，指針對特定事件結果進行押注，結算時僅有『是』或『否』兩種結果的衍生性金融商品）」，但多數交易熱點仍高度集中於體育賽事。這使得他們與 FanDuel 、 DraftKings 等傳統運動彩券巨頭展開了激烈競爭。
CFTC 始終主張，事件合約本質上屬於衍生品市場的一部分，因此該機構擁有絕對的專屬管轄權。 CFTC 甚至在今年 2 月提交的法律文件中提到，各州政府無權對預測市場平台進行監管。
然而，各州政府並未坐以待斃，紛紛祭出重拳反擊。內華達州近期成功取得臨時禁制令，攔下 Kalshi 提供與體育、選舉及娛樂相關的預測合約；亞利桑那州更直接對 Kalshi 母公司提起刑事訴訟，指控其無照經營非法賭博業務。面對猛烈砲火，Kalshi 強烈反駁上述指控，並敦促亞利桑那州撤回訴訟。
如今，這場法律拉鋸戰已蔓延至全美多個司法管轄區。包含麻薩諸塞州與密西根州皆已對 Kalshi 提起訴訟；而 Polymarket 為了自保，也在本月稍早反過來狀告密西根州，試圖阻擋該州博弈法規的強硬執法。此外，美國聯邦第九巡迴上訴法院近期駁回了 Kalshi 針對內華達州案件所提出的緊急中止執行請求，等同為其他州政府祭出進一步的封殺令開了綠燈。
儘管法規陰霾籠罩，預測市場的含金量仍吸引資本關注。據傳 Kalshi 與 Polymarket 近期正尋求以 200 億美元的估值進行融資。華爾街重量級機構如海納國際集團（Susquehanna）與 Jump Trading 也已在 Kalshi 擔任造市商，金融資訊服務商 Tradeweb 亦與該平台展開數據合作。
雖然有部分體育組織對預測市場可能導致的「操縱比賽」與「內線交易」疑慮日益加深，但美國職棒大聯盟（MLB）近期卻與 Polymarket 達成授權協議，允許該平台存取聯盟數據，但前提是雙方必須深度合作，嚴密監控任何可疑的博弈活動。
