目前，包括 Circle、Ripple、BitGo、Paxos 以及野村证券旗下的 Laser Digital 等机构，均在申请或已持有 OCC 的有条件信托银行牌照。与特朗普相关联的 World Liberty Financial 也提交了涵盖其1美元稳定币的申请。ABA认为，在《GENIUS法案》及配套规则尚未落地的情况下，OCC不应沿用传统审批节奏。
Marvel Capital 联合创始人 Anthony Agoshkov 指出，一旦这些机构获得联邦层级的结算与准入资格，可能跳过传统中介体系，实现原生、受监管的价值转移。这被视为加密资产迈向主流金融的关键门槛，但也引发传统银行的结构性担忧。
ABA特别批评OCC将特许审批与遵守《GENIUS法案》挂钩的做法，称该法案的全面实施仍需多年，并涉及多个监管机构的规则制定。该组织还援引2022年 FTX 与 Celsius 倒闭事件，警告新商业模式一旦失败，可能超出现有处置框架的应对能力。
此外，ABA主张禁止非银行信托公司使用“银行”字样，以避免公众误解其风险属性。围绕稳定币收益率的争议也在立法层面持续发酵，最新草案中已加入禁止加密公司向持有人支付任何利息的条款。这一变化促使 Brian Armstrong 公开反对相关立法，称其“可能比现状更糟”。
