Hong Kong is taking significant steps toward greater regulation of the digital asset sector. The Office of Financial Services and the Treasury has initiated the process of establishing regulatory sites and operational frameworks to enhance international tax transparency. Aiming to implement a robust cryptographic reporting system, Hong Kong authorities seek to align with international standards set by the Organisation for Economic Co-operation and Development (OECD).

Architecture of the New Regulatory Framework Setup

The Financial Affairs Committee of the Legislative Council has confirmed that legislative initiatives will be introduced throughout this year. Finance Secretary Christopher Hui and Deputy Secretary Joseph Chan will lead briefing sessions before the legislative body. These officials will detail the setup of monitoring sites and the automatic information exchange mechanisms that will be progressively deployed. The proposal incorporates the joint reporting standards developed by the OECD, ensuring compatibility with tax systems across multiple jurisdictions.

Automatic Tax Information Exchange System

The core mechanism envisions the automatic transmission of tax-related data concerning crypto-asset transactions starting in 2028. This system will enable Hong Kong and other tax authorities to share information in a coordinated manner, strengthening the ability to detect cross-border tax non-compliance. By establishing a standardized data exchange setup, it is expected to significantly reduce tax evasion schemes that exploit the current regulatory fragmentation between jurisdictions.

Ongoing Public Consultation

Currently, the government is gathering public opinions on the legislative proposals. This consultation period allows companies, investors, and technical experts in the crypto sector to share their perspectives on the feasibility and operational impact of the new framework.
